By accessing, downloading, using, reviewing and/or relying in any way upon materials published by or made available by or through the Aerostar Owners Association (the “AOA”, including, without limitation, AOA’s members, officers, directors, employees, agents, servants, guests, invitees, representatives, insurers, and attorneys), user (a “user”, including, without limitation, all users’ predecessors, successors, assigns, members, officers, directors, shareholders, employees, agents, servants, guests, invitees, representatives, family members, insurers, and attorneys, and any person or entity claiming by, through or under them, or any of them), irrespective of the manner and/or method in which the materials have been provided to user (for example print, digital, or otherwise, including, without limitation, all information on the AOA website) agrees to defend, indemnify, and hold the AOA harmless, and hereby releases, acquits, and forever discharges the AOA, from and against any and all claims, actions, causes of action, demands, liabilities, costs, losses, judgments, expenses, damages, settlements, and liability of every kind and/or nature, including all expenses of litigation, court costs and attorneys’ fees, whether arising from negligence, gross negligence, contract, strict liability in tort, or any other claim for damage to any property, or for injuries to or sickness or death of any person(s), including, but not limited to, any of user’s family members, caused by, arising out of, or related to, either directly or indirectly, or in any way connected with user’s use of any materials published by or made available by or through the AOA in any respect whatsoever, irrespective of whether any of such claims are brought by user or by any person or entity acting by, through, or under user, or by any third-party. This release and waiver includes and is intended to expressly release and waive AOA’s liability from the consequences of its own negligent acts and/or omissions. User additionally stipulates, acknowledges, and agrees to indemnify AOA against the consequences of AOA’s sole negligence or fault, and against the consequences of AOA’s own negligence or fault occurring jointly or concurrently with the negligence or fault of user.
